All or any reference to Aldon Hobby shall also be known as 2northx, or any other name used or owned by Aldon Hobby.
I. RIGHT TO SELL. In accordance with this Agreement, Seller is granted a right to sell the item, services, or product under the terms of this Agreement. This right to sell only applies to the following described on 2northx, our store at your door, or any other websites owned or operated by Aldon Hobby or it's associates web sites. Seller agrees to devote its best efforts to the website. In the event of Auctions, all auctions and bidding prices shall be determined at the time of auction.
II. PROCEEDS OF SALES. In the event of Auctions the Highest or Awarded Bidder or purchaser (Also in the case of Buy it now, or Buy it now only) will pay to Seller the auction proceeds, which shall be calculated by the Seller at the first submission of item for sale. The amount determined in the auction shall be paid to Seller in full, at the time of the closing of bids determined by the Seller.
III. RECORDS. Seller shall keep accurate records regarding the quantities of the Auctioned items that are sold. Seller is responsible for all fees payable to Aldon Hobby auction site. Aldon Hobby reserves the right to inspect such records at any time or duration and from time to time.
IV. TAXES. Seller shall be exclusively liable for any applicable State or Federal tax.
V. DEFAULTS. All defaults between the Seller and Bidder are to be resolved with no intervention from 2northx, Aldon Hobby and/or it's affiliates, partners, or associates. If Seller or buyer fails to abide by the obligations of the price posted, including the obligation to remit the highest bid payment to Seller when due, Seller shall have the option to cancel said auction. Highest Bidder shall have the option of preventing the termination of this Agreement by taking corrective action that cures the default, if such corrective action is taken prior to the end of the time period stated by the Seller, and if there are no other defaults during such time period.
VI. WARRANTIES. 2northX, Aldon Hobby, or affiliates, or DBA of Aldon Hobby does not make or imply any warranties with respect to the use, sale, transfer of currency, occurred during any transactions of any agreement by the Seller or Bidder, or by any third party.
In no event will 2northX or its affiliates be liable for direct, indirect, special, incidental, or consequential damages, or warrantees of products whether monetarily or physical that are in any way related to the sales or transactions, or services, Seller to Bidder, Bidder to Seller, or any contracts between any parties involved.
You also agree that 2northX, or Aldon Hobby or its affiliates shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that 2northX or its affiliates are under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release 2northX or its affiliates, its officers, employees, agents and successors in rights from claims, demands and damages (actual and/or consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
VII. TRANSFER OF RIGHTS. This Agreement shall be binding on any successors of the parties. Neither party shall have the right to assign its interests in this Agreement unless the prior written consent of the other party is obtained.
VIII. TERMINATION.Aldon Hobby and/or it's affiliates, partners, or associates provides online services that include but not limited to Web Stores, and auctions, to our registered users. By using this website in any way, you are agreeing to comply with all the Terms and conditions along with the guidelines of Aldon Hobby and/or it's affiliates, partners, or associates. In addition, when using our services, you agree to follow any posted guidelines for all our services, which may change without prior notice. If for any reason you should object to any terms, conditions, or become dissatisfied with the terms, or guidelines we impose, you should remove your account auctions, or any other activity from our website.
IX. ENTIRE AGREEMENT. This Agreement supersedes any prior written or oral agreements (Other than State or Federal Regulations) between the parties with respect to the subject matter of this agreement.
X CANCELATION/REFUSAL: ALDON HOBBY (Provider) RESERVES THE RIGHT TO CANCEL, CLOSE, REFUSE, OR ANY OTHER ACTION NECCESSARY IN ORDER TO KEEP THIS WEBSITE FREE FROM MISUSE
